These Terms of Service (“Terms”) govern your access to and use of the Giving Tree Gift Co website and online store (the “Site”) and the products and services we provide through it (collectively, the “Services”). In these Terms, “Giving Tree Gift Co,” “we,” “us,” and “our” refer to Giving Tree Gift Co.

Our store is hosted on Shopify Inc. (“Shopify”), which provides the e-commerce platform that allows us to sell our products and Services to you.

By visiting, browsing, or purchasing from our Site, you agree to these Terms and to the policies referenced here, including our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree, do not use the Services.

1.      Eligibility and Account Information

You must be at least the age of majority in your jurisdiction to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You may be asked to provide information such as your email address, billing, payment, and shipping details. You agree that all information you provide is accurate, current, and complete, and you will keep it updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2.      Products, Gift Boxes, and Product Information

We try to display product descriptions and photos as accurately as possible. However, colors and appearance may vary based on your device or screen settings, and curated boxes may include items that vary slightly in presentation or packaging while remaining consistent with the described theme, value, and intended experience.

We reserve the right to:

  • update product descriptions and pricing,
  • limit quantities,
  • discontinue products, and
  • restrict sales by person, region, or jurisdiction when necessary.

3.      Consumables, Allergens, and Dietary Information

Some gift boxes may include food, beverages, candy, tea, supplements, topical products, cosmetics, bath/body items, or other items that may be ingested or applied to the body (collectively, “Consumables & Sensitives”).

A.     Manufacturer-sealed items; no repackaging
Consumables & Sensitives are provided in original, manufacturer-sealed packaging. We do not open, alter, relabel, repackage, or otherwise modify these items.

 

B.     Ingredient and allergen information; label controls
Ingredients, allergen statements, nutrition information, warnings, directions, and other product details are determined by the manufacturer and may change without notice. Product images and descriptions on our Site are provided for convenience and general information only. You are responsible for reviewing the label on the product you receive (and, if needed, contacting the manufacturer directly) to confirm ingredients, allergen information, and suitability before use or consumption.

 

C.    Allergens and sensitivities
Consumables & Sensitives may contain, or may have been manufactured/processed in facilities that handle, common allergens or irritants (including, for example, milk, eggs, fish, shellfish, peanuts, tree nuts, wheat, soy, sesame, fragrance allergens, botanicals, or essential oils). We do not represent or guarantee that any item is allergen-free, fragrance-free, nut-free, gluten-free, vegan, cruelty-free, non-toxic, hypoallergenic, or suitable for any particular allergy, sensitivity, or dietary restriction.

 

D.     No medical advice; personal responsibility
We do not provide medical, health, allergy, or dietary advice. You are solely responsible for determining whether any item is safe and appropriate for you or any gift recipient, including based on allergies, sensitivities, pregnancy, medical conditions, medications, or dietary restrictions. Do not consume or use any item if you are uncertain about its ingredients or suitability.

 

E.      Gifts to third parties
If you purchase a gift for someone else, you are responsible for ensuring the recipient is aware of, and can review, ingredient/allergen information and any warnings or directions prior to use or consumption.

 

F.      Storage, shelf life, and transit conditions
Many Consumables & Sensitives are sensitive to temperature, humidity, sunlight, and time. “Best by,” “use by,” or similar dates (if any) are set by the manufacturer. Delivery and carrier handling conditions are outside our control, and we do not guarantee that items will not melt, soften, bloom, leak, or otherwise change in appearance or texture during shipment. Upon delivery, you are responsible for promptly retrieving, inspecting, and properly storing items according to the manufacturer’s guidance.

 

G.    Recalls and manufacturer remedies
If a manufacturer issues a recall or safety notice for a product we sold, we may post a notice on the Site and/or attempt to contact purchasers using the information provided at checkout. Remedies for recalls or product defects may be determined by the manufacturer and/or required by applicable law.

4.      Orders, Acceptance, and Cancellations

When you place an order, you are making an offer to purchase. We may accept or decline any order in our discretion, including due to suspected fraud, inventory constraints, pricing errors, shipping limitations, or other operational reasons.

An order is not accepted until we confirm it and successfully process payment.

Cancellations: We do our best to move quickly. If you need to cancel, contact us immediately. We may be unable to cancel or change an order once it has begun processing.

5.      Pricing, Taxes, and Payment

Prices are shown in the currency displayed at checkout and may change at any time. Taxes and shipping charges are calculated at checkout unless stated otherwise.

You agree to provide valid payment information and authorize us (or our payment processors) to charge your payment method for your order total, including applicable taxes and shipping.

If we discover an error related to pricing, promotions, or product information, we may correct it and, if necessary, cancel the order and issue a refund.

6.      Shipping, Delivery, and Risk of Loss

Delivery dates and transit times are estimates and are not guaranteed. Once an order is transferred to the carrier, title and risk of loss pass to you to the maximum extent permitted by law.

You are responsible for providing accurate shipping information and for promptly retrieving your package upon delivery. For items that are temperature- or time-sensitive (including Consumables & Sensitives), delays, missed deliveries, and extended exposure to heat/cold may impact product quality.

7.      Returns and Refunds

Because our gift boxes include curated items that cannot be resold once shipped, all sales are final except as described in our Return & Refund Policy: [LINK TO YOUR RETURN & REFUND POLICY].

For clarity, Consumables & Sensitives (including any food, beverage, candy, tea, supplements, topical products, cosmetics, and bath/body items) are not eligible for return or exchange, except where required by law or as expressly stated in our Return & Refund Policy.

8.      Intellectual Property

All content on the Site, including text, graphics, images, logos, designs, and product presentation (collectively, “Content”), is owned by or licensed to Giving Tree Gift Co and is protected by intellectual property laws.

You may use the Services for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Content without our prior written permission.

9.      User Content and Feedback (Reviews, Comments, Submissions)

If you submit reviews, comments, photos, ideas, suggestions, or other content (“Feedback”), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display that Feedback for business purposes (including marketing), subject to applicable law.

A.     You represent that your Feedback:

·       is truthful and not misleading,

·       does not infringe the rights of others, and

·       does not contain unlawful, abusive, or obscene content.

B.     We may remove Feedback at our discretion.

10. Prohibited Uses

You agree not to misuse the Services. You may not:

·       violate laws or regulations,

·       infringe intellectual property or privacy rights,

·       attempt to interfere with the Site’s security or operation,

·       transmit malware, spam, or fraudulent content, or

·       engage in conduct that harms us, Shopify, or other users.

We may suspend or terminate access to the Services if we believe you violated these Terms.

11. Third-Party Services and Links

The Site may include links to third-party websites or services. We do not control and are not responsible for third-party content, products, or practices. Your use of third-party sites is at your own risk and subject to their terms.

12. Relationship with Shopify

Giving Tree Gift Co is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Giving Tree Gift Co. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Giving Tree Gift Co, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Giving Tree Gift Co.

13. Disclaimers

To the maximum extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, Giving Tree Gift Co (and its owners, employees, contractors, and service providers) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

To the maximum extent permitted by law, our total liability for any claim related to an order or the Services will not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Giving Tree Gift Co and Shopify (and their affiliates and service providers) from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.

16. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms. Sections that by their nature should survive termination will survive.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

18. Changes to These Terms

We may update these Terms from time to time by posting a new version on the Site and updating the “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
